Solstice Calisthenics Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Solstice Calisthenics ("Solstice," "we," "us," or "our") governing the Solstice Calisthenics app, website, and related services (the "Service").

By downloading, accessing, creating an account for, or using the Service, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old. If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms and supervise your use. You must meet any higher minimum age or parental-consent requirement that applies where you live.

You may not use the Service if applicable law prohibits you from receiving it. If you use the Service for an organization, you represent that you can bind that organization.

2. Fitness, Health, and Medical Warning

The Service is a workout logging, planning, education, and motivation tool. It is not a medical device and does not provide medical advice, diagnosis, treatment, physical therapy, rehabilitation, emergency monitoring, or professional coaching.

Exercise, calisthenics, resistance training, skill practice, and equipment use involve inherent risks, including overexertion, falls, equipment failure, serious injury, disability, and death. Service information is general and may be incomplete, inaccurate, unsuitable for you, or affected by data-entry and software errors.

Before beginning or changing a program, consult a qualified health professional where appropriate, especially if you are pregnant, inexperienced, returning after inactivity, taking medication, or have an injury, illness, disability, pain, dizziness, breathing issue, heart condition, or other concern. Use appropriate equipment, surroundings, supervision, spotting, progressions, and safety precautions. Stop immediately if you experience pain, faintness, dizziness, unusual shortness of breath, chest discomfort, or another concerning symptom.

Never attempt a movement merely because the Service displays, recommends, tracks, rewards, or marks it as available. You decide whether and how to perform every activity.

If you believe you are experiencing a medical emergency, stop using the Service and contact local emergency services.

3. Assumption of Risk

You voluntarily choose to perform workouts and skills. To the fullest extent permitted by law, you knowingly assume the ordinary and inherent risks of those activities and responsibility for assessing your health, ability, equipment, environment, technique, supervision, and readiness.

To the fullest extent permitted by law, you release Solstice and its owner, developer, contributors, and service providers from claims arising from risks inherent in exercise or your decision to perform an activity, except where a claim cannot lawfully be released or results from liability the law does not permit us to exclude.

Nothing in these Terms removes rights or remedies that cannot legally be excluded.

4. Accounts

An account is optional for core local features but may be required for cloud save, profile synchronization, and public profiles.

You agree to provide accurate information, protect your credentials and device, use only an account you are authorized to use, and notify us of suspected unauthorized access. You are responsible for account activity to the extent permitted by law.

We may require email verification or recent authentication for sensitive actions. Delete your account in Profile settings or request deletion at https://solsticecalisthenics.com/delete-account/.

5. License and Permitted Use

Subject to these Terms, Solstice grants you a personal, limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to use the Service for its intended purpose on devices you own or control, subject to platform usage rules.

You may create, publish, stream, and monetize screenshots, videos, reviews, tutorials, commentary, and social posts showing ordinary use of the Service, provided you comply with law and these Terms and do not imply sponsorship or endorsement.

6. Acceptable Use

You must not:

• Use the Service unlawfully, fraudulently, deceptively, abusively, or to harm another person
• Impersonate another person or misrepresent affiliation, identity, achievements, or status
• Post unlawful, infringing, hateful, threatening, harassing, sexually explicit, exploitative, or privacy-invasive content
• Share another person's private or sensitive information without permission
• Attempt unauthorized access to accounts, data, systems, or security controls
• Introduce malware or interfere with the integrity, availability, or operation of the Service
• Scrape, harvest, probe, overload, or automate access except through functionality we provide or where law permits
• Reverse engineer, decompile, or extract source code except where law does not allow that restriction
• Copy, sell, rent, sublicense, redistribute, or create a competing service from protected parts of the Service
• Manipulate progression, rewards, public profiles, or records through exploits or unauthorized tools
• Violate a third party's rights or applicable platform rules

We may investigate, limit, remove, suspend, or terminate access when reasonably necessary to enforce these Terms, protect users, comply with law, or secure the Service.

7. Your Content and Data

You retain ownership of content and information you submit.

You grant Solstice a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt for technical formatting, transmit, display, and process your content only as reasonably necessary to provide, secure, maintain, and enforce the Service. For public-profile content, this includes displaying it while the profile is enabled. The license ends when content is deleted from active systems, except for lawful retention, technical backup cycles, and copies outside our control.

You represent that you have the rights and permissions necessary for submitted content and that it does not violate law or another person's rights. Personal information is handled under the Privacy Policy.

8. Public Profiles and Sharing

Public profiles and sharing are optional. If you use them:

• You choose and are responsible for the information you publish or send
• Public information may be viewed, copied, recorded, or redistributed by others
• Destination services apply their own terms and privacy practices
• Disabling or deleting a profile cannot erase copies made outside the Service
• We may remove or restrict content that violates these Terms or creates legal, safety, privacy, or security risk

Do not publish information you want to keep private.

9. Virtual Rewards and Shop Items

XP, levels, streaks, coins, achievements, quests, virtual shop items, inventory, and unlocks are entertainment and progression features only. They have no cash value, create no property right, and may be corrected, rebalanced, limited, reset, suspended, or removed for errors, abuse, balancing, or Service changes. Unless expressly stated otherwise, virtual items are not bought with real money and are not transferable.

10. Cloud Save, Local Data, and Backups

Cloud save, export, import, and restore are conveniences, not guaranteed archival or disaster-recovery services.

You acknowledge that:

• Data may be lost through device failure, uninstalling, user action, software errors, conflicts, corruption, provider outages, or discontinued features
• Cloud save may overwrite or conflict with local information
• Exported backups may contain sensitive workout, body, injury, illness, profile, and account-related information
• Local JSON backups are not encrypted by Solstice
• You are responsible for securing exported files and maintaining independent backups you require

Clearing local data does not delete cloud data. Deleting cloud data does not delete local data or exported copies. Account deletion is designed to delete the account and associated app-managed cloud data, then clear app-managed local data on the device where deletion is performed. See the Privacy Policy.

11. Third-Party Services

The Service relies on or links to services including Firebase Authentication, Google Cloud Firestore, Google Sign-In, PurgoMalum, Google Forms, device notification services, file selectors, and sharing services.

Third-party terms and privacy policies may apply. Solstice does not control and is not responsible for third-party content, policies, security, performance, availability, or actions.

12. Intellectual Property

The Service, including its software, branding, design, text, graphics, exercise library, skill-tree structure, progression systems, animations, and other non-user content, is owned by or licensed to Solstice and protected by law. Except for the limited license in these Terms, no right, title, or interest is transferred to you. Solstice names, logos, and branding may not be used to imply endorsement without written permission.

Open-source software components remain subject to their own licenses.

If you submit feedback, you allow us to use it without restriction or compensation, while retaining ownership of underlying content you own.

13. Changes, Availability, and Updates

We may add, change, correct, rebalance, suspend, or discontinue features or the Service and may require a supported version for security or compatibility. We do not promise that any feature, format, exercise, progression path, integration, or platform version will remain available.

We will provide notice where required. If you do not agree to a material change, stop using the Service and delete your account.

14. Suspension and Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, created risk or harm, used the Service unlawfully, or if needed to protect the Service or comply with law.

Provisions that by nature should survive termination remain effective, including ownership, disclaimers, liability limits, indemnity, dispute terms, and provisions concerning previously shared content.

15. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available." Solstice disclaims express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and that results will meet your needs.

We do not warrant that training information, calculations, timers, charts, progressions, reminders, or rewards are complete, accurate, safe, or suitable; that the Service will be uninterrupted, error-free, secure, or universally compatible; that data will never be lost or disclosed; or that third-party services will remain available.

Some jurisdictions do not allow certain exclusions, so some may not apply to you.

16. Limitation of Liability

To the fullest extent permitted by law, Solstice and its owner, developer, contributors, licensors, and service providers will not be liable for:

• Injury, illness, disability, death, accident, or property damage connected with exercise, skill practice, equipment, or reliance on Service content
• Loss, corruption, disclosure, or failure to restore data
• Indirect, incidental, special, consequential, exemplary, or punitive damages
• Loss of profits, opportunity, goodwill, reputation, or business interruption
• Conduct, content, products, or services of another user or third party

To the fullest extent permitted by law, total aggregate liability for all claims relating to the Service will not exceed the greater of the amount you paid directly to Solstice during the 12 months before the event giving rise to the claim or AUD $100.

These limits apply regardless of legal theory and even if a remedy fails, but not to fraud, willful misconduct, gross negligence where it cannot lawfully be limited, or liability that law does not permit us to limit or exclude.

Australian consumer law

Nothing in these Terms excludes, restricts, or modifies a consumer guarantee, right, or remedy under the Australian Consumer Law or another law that cannot lawfully be excluded. Where permitted, our liability for failure to comply with a non-excludable guarantee is limited, at our option, to supplying the services again or paying the cost of having them supplied again.

17. Indemnity

To the fullest extent permitted by law, you agree to indemnify Solstice and its owner and developer from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful use, your content, or your material breach of these Terms.

This does not require indemnity for another person's unlawful conduct, negligence where prohibited, or liability that cannot legally be shifted to you.

18. Disputes and Applicable Law

Before filing a claim, you and Solstice agree to make a reasonable, good-faith attempt to resolve it by emailing SolsticeCalisthenics@gmail.com and allowing 30 days for a response. This does not prevent urgent relief or use of a regulator, tribunal, or small-claims process.

Applicable law and jurisdiction are determined by mandatory law and ordinary conflict-of-law rules. Nothing deprives you of mandatory consumer protections or a forum guaranteed by law.

19. Apple App Store Terms

This section applies only if the Service is distributed through Apple's App Store:

• These Terms are between you and Solstice, not Apple. Solstice, not Apple, is responsible for the Service and its content.
• Your license is limited to Apple-branded products you own or control as permitted by Apple Media Services terms and applicable Family Sharing or volume-purchase rules.
• Apple has no maintenance or support obligation.
• If the Service fails to conform to an applicable warranty, you may notify Apple, and Apple may refund any purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation.
• Solstice, not Apple, is responsible for product-liability, legal-compliance, consumer-protection, and intellectual-property claims concerning the Service.
• You represent that you are not in a country subject to a U.S. Government embargo and are not on a U.S. Government prohibited or restricted-party list.
• You must comply with applicable third-party terms.
• Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you.

20. General Terms

If a provision is unenforceable, it will be enforced to the maximum lawful extent and the rest remains effective. Failure to enforce is not a waiver. You may not assign these Terms without consent; we may assign them with a reorganization or Service transfer, subject to law. These Terms and the Privacy Policy are the entire agreement concerning the Service unless additional written terms expressly apply. "Including" means "including without limitation."

21. Changes to These Terms

We may update these Terms. We will revise the effective date and provide additional in-app notice for material changes. Continued use after updated Terms take effect constitutes acceptance where permitted. If law requires affirmative consent, we will request it.
